Terms of Service

Last updated: July 2025. These terms apply to dunked.ca and all Dunked services.

1. Acceptance of terms

By accessing or using the Dunked website or placing an order, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.

2. Orders and payment

All orders are subject to availability. Prices are in Canadian dollars and include applicable taxes. Payment is processed securely through Stripe. You authorise us to charge your payment method for the total order amount at the time of checkout. We reserve the right to cancel or refuse any order.

3. Delivery

Delivery is available within our designated delivery zone in London, Ontario. Delivery fees and minimum order amounts are calculated at checkout based on your address. Estimated delivery times are approximations and not guarantees. We are not responsible for delays caused by circumstances outside our control.

4. Cancellations and refunds

Orders can only be cancelled before they have been confirmed by our kitchen. Once an order is confirmed, cancellation is at our discretion. Refunds for cancelled orders are processed to the original payment method within 5–10 business days. Food quality issues must be reported within 2 hours of order receipt.

5. Loyalty program

Participation in the Dunked Rewards program is subject to the program's specific terms. Points have no cash value, cannot be transferred, and may expire or be forfeited in cases of fraud or account termination. We reserve the right to modify or discontinue the loyalty program at any time.

6. Gift cards

Gift cards are non-refundable and are not redeemable for cash. Gift cards are valid for one (1) year from the date of purchase. Lost or stolen gift cards will not be replaced. We are not responsible for unauthorised use. See the Gift Card Terms for full details.

7. User accounts

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these terms.

8. Intellectual property

All content on this website including text, graphics, logos, and images is the property of Dunked and may not be reproduced without written permission.

9. Limitation of liability

To the maximum extent permitted by applicable law, Dunked shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid for the order giving rise to the claim.

10. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.

11. Changes to terms

We may update these terms at any time. Continued use of our services after changes constitutes acceptance of the updated terms. Significant changes will be communicated by email to registered users.
